FOGO mandates custom exemption application

This exemption form is only applicable to entities who must comply with the FOGO mandates. For the household mandate, this only includes local councils. For the business mandate, this only includes the ‘relevant premises’ listed in section 170B of the Protection of the Environment Operations Act 1997.

The Protection of the Environment Operations Act 1997 (Chapter 5A) (POEO Act) mandates source-separated FOGO collection from households that receive a red lid waste collection service, and from certain businesses and institutions that meet weekly residual waste bin capacity thresholds. Under the POEO Act, the EPA may grant exemptions to the FOGO mandates. To apply for a custom exemption, please read the Custom Exemption Procedure and complete the form below.

This exemption form does not apply to households that receive a waste collection service from their council. If you are receiving, or will receive, a FOGO collection service from your council, you can contact the council for further information.

False or misleading information

It is an offence to supply information to the EPA that is false or misleading in a material respect. There is a maximum penalty of $1,000,000 for a corporation or $500,000 for an individual.

Privacy

The EPA collects and manages the personal information you provide according to the Privacy and Personal Information Protection Act 1998. Providing your personal information is voluntary; however, the EPA may not be able to process your application without it.

The EPA collects this information to assess requests for exemptions from the FOGO mandates. Personal information collected by the EPA may be disclosed to the people assessing the exemption application. See also the confidentiality section below regarding the EPA publishing information in certain circumstances. 

Once the EPA has collected your personal information, you have the right to access and correct any of it at any time. To do this, contact the EPA Stakeholder Engagement and Communications Branch.

Confidentiality

The name of the applicant or organisation and other details may be disclosed in public documentation and be made publicly available by the EPA. Additionally, the EPA intends to have all granted custom exemptions published in the NSW Government Gazette and on the EPA website unless there are valid confidentiality concerns. If you require strict commercial and/or personal confidentiality of your application and/or any relevant granted exemption, please set this out and provide relevant details when emailing your application.
