Forms: continued need for a plastic item and seeking an exemption

The following forms relate to the Plastic Reduction and Circular Economy Act 2021.

The Plastic Reduction and Circular Economy Act 2021 (PRCE Act) bans the supply of certain problematic and unnecessary plastic items into or within NSW.

The EPA is the sole regulator of the bans and plays a key role in regulating and monitoring certain types of plastic items supplied into or within NSW.

There are 2 forms:

  • Continued need to access and/or use a banned item: This form is for those interested in providing feedback about a continued need for access to and/or use of a banned item. This form is not an application for an exemption under the PRCE Act. Rather, the form provides a mechanism for individuals to bring any issues arising from the banning of particular items to the EPA’s attention.
  • Exemption enquiry: This form is for expressions of interest in applying for an exemption from the PRCE Act. It is to be used by organisations or individuals ‘carrying on a business’ in NSW. The form is not an application for an exemption under the PRCE Act, but will help guide you through the types of questions that you may need to answer in further detail, after the EPA has considered your enquiry.
