Conservation Agreements with a statutory authority or another minister

The Minister may enter into a Conservation Agreement under Section 69B of the National Parks & Wildlife Act 1974. Section 69C states the purpose and content of Conservation Agreements.

Under Section 69K of the National Parks and Wildlife Act 1974 (the Act), public notice, public exhibition, and submissions from the public and from the National Parks and Wildlife Advisory Council must be invited and considered before the Minister enters into a Conservation Agreement with a statutory authority or another Minister, or Crown lands or lands of the Crown.

Section 69K (5) states that this requirement does not apply if the proposed Conservation Agreement is over land leased by a person (other than a statutory authority or Minister) if the lease is made under the Crown Lands Act 1989, the Crown Lands (Continued Tenures) Act 1989 or the Western Lands Act 1901).

DECC invites public comment on the following draft conservation agreements and draft plans of management for lands subject to conservation agreement.

Draft conservation agreements with a statutory authority or another minister

A draft Conservation Agreement over land at Shannon Creek, near Coutts Crossing, managed by North Coast Water, a business unit of the Clarence Valley Council, has been prepared, in partnership with DECC. The Conservation Agreement protects significant natural heritage conservation values in perpetuity.

The draft Conservation Agreement may be inspected during office hours for a period of 30 calendar days from 30 July 2008 at:

  • Department of Environment and Climate Change, Level 2, 49 Victoria Street, Grafton 2460
  • Clarence Valley Council, 2 Prince Street, Grafton 2460
  • Department of Environment and Climate Change Level 14, 59-61 Goulburn Street, Sydney 2000

Written submissions are invited on the draft Conservation Agreement and should be forwarded to The Manager, Conservation Partnerships, Landscape Ecosystems Conservation Branch, DECC, PO Box A290, Sydney South, NSW 1232 by 30th August 2008.

The Minister will consider all submissions prior to signing the Conservation Agreement.  All submissions received by DECC are a matter of public record and are available for public inspection upon request to DECC. Comment on this draft Conservation Agreement may contain information that is defined as 'personal information' under the NSW Privacy and Personal Information Protection Act 1998 and will be administered in accordance with this legislation.
